The "fair use" doctrine as laid out in the Fair-Use Statute Section 107 of the 1976 Copyright Act, allows reproduction and other uses of copyrighted works under certain conditions for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship or research for educational and research purposes.

The following four factors are used to determine fair use:

1. The purpose of the use (eg. commercial vs. educational)
2. The nature of the copyrighted work
3. The amount of the material used (the greater the amount copied, the less likely it is fair use)
4. The effect of use on the potential market for or value of the work
